Terms of Service

These Terms of Service (“Terms”) govern your use of the Track50 platform (“Service”) operated from New Delhi, India. By creating an account or using the Service, you agree to these Terms.
1. The Service
Track50 is a software-as-a-service (SaaS) product that helps merchants—especially Shopify stores—manage in-house delivery teams: order import, assignment to delivery staff, OTP proof of delivery, shipping labels, invoices, branded tracking pages, NDR handling, and Shopify status sync. The Service is not a third-party logistics (3PL) provider or national courier booking platform; you use your own delivery personnel.
2. Eligibility
You must be at least 18 years old and authorized to bind your business. You represent that information you provide is accurate and that you will comply with applicable laws (consumer protection, data privacy, e-commerce, etc.).
3. Accounts & security
You are responsible for all activity under your account and for your delivery staff credentials. Notify us immediately of unauthorized access at kumardharamraj2017@gmail.com.
4. Subscriptions & payments
Paid plans are billed in advance via Razorpay (INR, India) or Stripe (international cards) as shown at checkout. Prices and plan limits are described on our website and in your dashboard. Failure to pay may suspend or terminate access. See our Refund & Cancellation Policy.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or to harass customers.
- Reverse engineer, scrape, or overload our systems.
- Share accounts across unrelated businesses without authorization.
- Upload malware or infringing content.
6. Your data & Shopify
You retain ownership of your store and customer data. You grant us a license to process data solely to provide the Service. You must have lawful basis to collect and use customer phone numbers and addresses (e.g. for OTP delivery). Shopify API use is subject to Shopify’s terms as well.
7. Third-party services
Integrations (Shopify, Razorpay, Stripe, SMS gateways, SMTP) are provided by third parties. We are not liable for their outages or policy changes.
8. Disclaimer
The Service is provided “as is” to the maximum extent permitted by law. We do not guarantee uninterrupted operation or specific delivery outcomes for your end customers—that remains your responsibility as the seller.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising from the Service is limited to the fees you paid us in the twelve (12) months before the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or failed deliveries.
10. Indemnity
You will indemnify us against claims arising from your use of the Service, your products, your delivery operations, or violation of these Terms.
11. Termination
You may cancel your subscription per the Refund Policy. We may suspend or terminate accounts for breach, non-payment, or legal requirement. Upon termination, access ends; export your data before cancellation where possible.
12. Governing law
These Terms are governed by the laws of India. Courts at New Delhi, India shall have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
